Lull - Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Lull: Sleep Aid & Fan application ("App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal iOS device for your own personal, non-commercial use, subject to these Terms and Apple's App Store Terms of Service.

3. In-App Purchases

Lull offers the following in-app purchase options:

Remove Ads (Lifetime): A one-time purchase that removes banner and interstitial ads from the App for as long as you own the App.
Pro (Lifetime): A one-time purchase that unlocks all fan sounds and removes ads permanently.
Pro (Yearly): An auto-renewable subscription that unlocks all fan sounds and removes ads, renewing annually unless cancelled.

All purchases and refunds are managed by Apple through the App Store. Billing occurs through your Apple ID, and charges will appear on your iTunes invoice. You are responsible for any applicable taxes. Please refer to Apple's App Store Terms of Service for complete information on purchase policies and refunds.

4. Auto-Renewable Subscription Terms

If you subscribe to the yearly Pro plan:

Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period.
You will be charged for renewal within 24 hours before the end of the current period.
Manage your subscription or cancel renewal through your Apple Account Settings at any time.
No refunds are provided for the unused portion of any subscription period.

5. Audio Content and Remote Updates

Lull generates fan sounds procedurally at runtime—there are no pre-recorded audio files. The app may periodically fetch updated fan profiles, parameters, or new fan sounds from our servers. These updates are delivered automatically when you use the App and require an internet connection.

6. Third-Party Advertising

The App displays advertisements from Google AdMob. By using the free version of the App, you consent to the display of these ads. You can remove ads by purchasing the Remove Ads or Pro products. Please see our Privacy Policy for information on how Google collects and uses data for advertising purposes.

7. Restrictions

You agree not to:

Modify, adapt, translate, or create derivative works of the App.
Reverse-engineer, decompile, or attempt to extract the source code of the App.
Use the App for any commercial purpose or to compete with us.
Rent, lease, or lend the App.
Use the App in a way that violates any applicable law or regulation.

8. Intellectual Property

The App, including all code, design, text, and audio generation algorithms, is owned by Davit Ghushchyan or licensed to him. All rights are reserved. You do not own the App; you have only the limited license granted above.

9. Disclaimer of Warranties

The App is provided "as is" without warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or fit for any particular purpose. The App is not a medical device and should not be used as a substitute for professional medical advice.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

11. Termination

We may terminate or suspend your access to the App at any time for violations of these Terms or for any reason in our sole discretion. Upon termination, your right to use the App ceases immediately.

12. Changes to These Terms

We may modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the App following any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.
